1. About this Policy
The trustee for Yap Business Trust, ABN 64 084 745 374, trading as Test Champs WA and formerly Scholastic Excellence, is referred to in this policy as “Test Champs WA”, “we”, “us” or “our”.
This policy explains how we collect, hold, use, disclose and protect personal information. It applies to our websites, enrolment and learning platforms, tutoring services, assessments, communications, payments, recruitment, contractor engagement, franchise activities and other dealings with students, parents, guardians and members of the public.
We manage personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles and other applicable laws. Where consent is required, we will request it separately and clearly. This policy does not treat your use of our website as consent to every information-handling practice.
We may provide a specific collection notice when we collect information. A collection notice gives details relevant to that particular form, service or activity and should be read with this policy.
2. What Personal Information Means
Personal information is information or an opinion that relates to an identified individual or an individual who is reasonably identifiable. It may be recorded in electronic, paper, audio, video or other form.
Sensitive information is a protected category of personal information. It includes health information, disability information, racial or ethnic origin, religious beliefs, criminal records and biometric information. We only collect sensitive information when it is reasonably necessary for our activities and we have consent or another lawful basis.
3. Information We May Collect
The information we collect depends on how you interact with us. It may include:
Student details, such as name, date of birth, age, school year, school, contact details and parent or guardian details.
Education information, such as school reports, academic results, assessment responses, attendance, class placement, learning progress, feedback, study needs and goals.
Health, disability, allergy, emergency, accessibility or learning adjustment information where needed to support a student safely and effectively.
Parent and guardian information, such as name, contact details, relationship to the student, communication preferences and billing details.
Enrolment, account and transaction information, such as selected courses, class locations, invoices, payment status, refunds and transaction references.
Communications, including enquiries, emails, telephone notes, feedback, complaints and customer service records.
Images, recordings, testimonials and student work where we have the required permission.
Website and device information, such as IP address, browser type, device identifiers, pages viewed, referral source, cookies and analytics data.
Employment and contractor information, such as qualifications, work history, references, Working with Children Check details, screening information and payroll or banking details.
Franchise enquiry and franchise management information, such as contact details, business experience, professional history, financial capacity information and due diligence records.
Any other information you provide or that we are required or authorised by law to collect.
Payment card details are generally collected and processed by our payment service providers. We may receive transaction details, payment status, card type and limited card information, but we do not ordinarily store complete card numbers or security codes.
4. How We Collect Information
We may collect personal information:
directly from you, a student, parent, guardian, applicant, contractor, franchise prospect or franchisee
through enrolment forms, enquiries, assessments, surveys, competitions, class activities, telephone calls, emails and face-to-face interactions
through our websites, online accounts, learning systems, booking tools, payment services, cookies and analytics tools
from authorised representatives, referees, schools, education providers, service providers, franchisees or business partners where lawful and appropriate
from public sources, including professional directories, business registers and public websites when required or authorised by law.
Where practicable, you may contact us anonymously or use a pseudonym for a general enquiry. We usually need accurate identifying information to enrol a student, provide classes, process payments, confirm authority, manage safety or comply with legal obligations.
5. Why We Collect, Use and Disclose Information
We collect, use and disclose personal information for purposes that include: responding to enquiries and providing information about our programs
processing enrolments, creating accounts and delivering tutoring, assessments and learning support
assessing learning needs, recommending classes and monitoring progress
communicating with students, parents and guardians about attendance, results, schedules, changes, safety and administration
processing fees, payments, refunds, invoices and accounting records
managing student welfare, emergencies, accessibility and reasonable adjustments improving our teaching, curriculum, systems, customer service and business operations
managing complaints, disputes, quality assurance, fraud prevention and legal claims recruiting, screening and managing employees and contractors
assessing franchise enquiries and supporting franchise operations
sending marketing communications where permitted by law
meeting insurance, regulatory, safeguarding, taxation, employment and other legal obligations.
We will not use or disclose personal information for an unrelated purpose unless you consent or the use or disclosure is otherwise permitted or required by law.
6. Children and Young People
Most of our services are provided to children and young people. We take their privacy, safety and best interests seriously.
We use clear, age-appropriate explanations when collecting information directly from a child or young person.
We consider whether the child or young person has the maturity and capacity to understand and provide consent. Where they do not, we seek consent from a parent or guardian.
We limit collection to information that is reasonably necessary for education, administration, safety or another stated purpose.
We do not use a child’s sensitive information for direct marketing.
We seek specific permission before using identifiable student images, recordings, testimonials or work for promotional purposes.
Parents and guardians may contact us about a child’s information, subject to identity, authority, the child’s maturity and any legal restrictions.
7. Who We May Share Information With
We may disclose personal information to recipients such as:
our employees, teachers, tutors, contractors and authorised administrators who need the information to perform their duties
Test Champs WA franchisees and related education locations where needed to respond to an enquiry, manage an enrolment or provide services
technology, cloud hosting, learning platform, customer management, email, messaging, analytics, cybersecurity and IT support providers
payment processors, banks, accountants, auditors and debt recovery providers professional advisers, insurers, investigators and dispute resolution providers
schools, venue operators, emergency services, health professionals or guardians where reasonably necessary for safety or service delivery
government agencies, regulators, courts, tribunals and law enforcement bodies where required or authorised by law
another organisation involved in a proposed or completed business sale, restructure, merger or transfer, subject to appropriate confidentiality and privacy controls.
Some Test Champs WA locations may be operated by franchisees that are separate legal entities. A franchisee may provide its own privacy notice for information it controls. We require franchisees and service providers to handle information securely and only for authorised purposes.
We do not sell or rent personal information to third parties.
8. Overseas Storage and Disclosure
Some technology and service providers may store, process or support personal information outside Australia, including in the United States and other countries in which their data centres or support teams operate. Provider locations may change over time.
Before disclosing personal information to an overseas recipient, we take reasonable steps required by APP 8 to ensure that the recipient handles the information consistently with the Australian Privacy Principles, unless an exception applies. Where practicable, a collection notice will identify the relevant countries. You may contact our Privacy Officer for current information about our main overseas service locations.
9. Direct Marketing
We may use contact information to send details about courses, events, enrolment dates, resources and services where you have consented or where the law otherwise permits it. Marketing messages will identify us and provide a simple way to unsubscribe.
You may opt out at any time by using the unsubscribe link, replying “UNSUBSCRIBE”, or contacting us. We will action the request within a reasonable period. Service messages about an existing enrolment, payment, class or safety matter are not marketing messages.
10. Cookies, Analytics and Online Technologies
Our websites and online services may use cookies, pixels, log files and similar technologies to:
operate the website and maintain security
remember preferences and improve usability
measure website traffic and performance
understand how visitors find and use our services
support advertising or campaign measurement where permitted.
These technologies may collect IP addresses, device identifiers, browser details and online activity. Depending on the circumstances, this information may be personal information. You can control cookies through your browser or available website settings, although disabling some cookies may affect website functions.
11. Security and Retention
We take reasonable technical and organisational steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure. These steps may include access controls, authentication, secure systems, encryption where appropriate, backups, staff confidentiality, provider checks, monitoring and incident response procedures.
No method of electronic transmission or storage is completely secure. If we become aware of a security incident, we will act promptly to contain it, assess the risks and reduce potential harm.
We retain personal information only for as long as it is reasonably needed for the purpose for which it was collected, for legitimate business and safeguarding requirements, or to meet legal, taxation, employment, insurance and record-keeping obligations. When information is no longer required, we take reasonable steps to securely destroy it or de-identify it.
12. Data Breaches
We maintain procedures for responding to suspected or confirmed data breaches. We will investigate and assess a breach as required by law. If an eligible data breach is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner and provide recommended steps to reduce harm.
13. Access and Correction
You may request access to personal information we hold about you and ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading.
We may need to verify your identity and authority before responding. We do not charge an application fee. We may charge a reasonable amount for providing access where permitted, and we will explain any charge before proceeding.
We aim to respond within 30 days. In some circumstances, the law allows or requires us to refuse access or correction. If we refuse, we will provide written reasons where required and explain how you may complain.
14. Automated Decision-Making
We may use software to support administrative tasks, such as processing forms, scheduling, payment processing, communications and record management.
From 10 December 2026, privacy policies must provide specific information where a computer program makes, or substantially and directly assists in making, a decision that could reasonably be expected to significantly affect an individual’s rights or interests. At the date of this policy, we have not identified a process of this kind. If this changes, we will update this section to describe the kinds of decisions made and the kinds of personal
15. Privacy Complaints
You may complain if you believe we have mishandled personal information or failed to meet our privacy obligations. Please contact our Privacy Officer in writing and include enough information for us to understand and investigate the issue.
We will acknowledge your complaint, investigate it fairly and aim to provide a written response within 30 days. More complex matters may take longer, and we will keep you informed.
If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner. The OAIC generally expects you to first give the organisation an opportunity to respond.

17. Changes to this Policy
We review this policy regularly and may update it when our practices, technology or legal obligations change. The current version will be published on our website with its effective date. Where a change materially affects how we handle information, we will take reasonable steps to provide additional notice.
